Branch County Will Not Prosecute Capri Owners

(COLDWATER) – Branch County authorities will not be prosecuting the owners of the Capri Drive In after they opened, defying Michigan's Stay Home Stay Safe order.

An official with the Branch County Prosecutor's Office says Prosecutor Valerie White will not seek charges against Tom and Sue Magocs for opening, despite Governor Gretchen Whitmer's Executive Order that does not allow for theaters to be open yet. It will now be up to the Michigan Attorney General's Office if there will be legal ramifications for the Coldwater business owners.

The Michigan State Police investigated the Capri being open on May 15, after they received several calls from citizens. According to troopers, there was a line of vehicles waiting to get in to the drive in that stretched back almost one mile.

The Magocs said they would use social distancing guidelines, and also had rules posted both on line and at the drive in.

The Capri plans to have movies showing again this weekend.
