Noble Judge considers request to move murder trial

ALBION - A Noble County judge must decide whether to move a Fort Wayne man’s murder trial to Allen County or keep it in Albion.
Noble Superior Court Judge Robert Kirsch took a request from Public Defender James Abbs to dismiss the case or send it to Allen County under advisement.
Abbs represents 35-year-old Andres Gonzalez Jr. He’s charged with the murder of 36-year-old Erin Justin. Fishermen found her body in Bartley Lake in 2011 about a month after she disappeared from Fort Wayne.
Prosecutors believe Gonzalez killed Justin and dumped her body in the lake with the help of his brother. 32-year-old Victor Gonzalez is charged with assisting a criminal and removing a body from the scene of a violent or suspicious death.
On Tuesday Abbs argued the state’s constitution requires those charged with a crime to be tried in the county where it was alleged to occur.
