(ALBION) - The murder case involving 35-year-old Andres Gonzalez Junior continues to take some legal twists. Noble Superior Court Judge Robert Kirsch has ordered the case against Gonzalez moved to Allen County following a defense motion. Gonzalez is charged with the murder of 36-year-old Erin Justin. Fishermen found her body in Bartley Lake in 2011 about a month after she disappeared from Fort Wayne. Prosecutors believe Gonzalez killed Justin and dumped her body in the lake with the help of his brother. 32-year-old Victor Gonzalez is charged with assisting a criminal and removing a body from the scene of a violent or suspicious death. Noble County Public Defender James Abbs has raised the question of where the alleged crime took place. He managed to convince the judge that the state’s constitution requires those charged with a crime be tried in the county where the crime was alleged to have taken place. After Kirsch's ruling on Wednesday, the prosecution has filed a stay of that ruling. If the judge grants the stay, then prosecutors will have 30 days to prepare its arguments before the matter is presented to the State Court of Appeals.
